Brad's expertise is strongest at the intersection of construction, commercial litigation, real estate, employment, and secured transactions. He represents developers, owners, operating companies, professionals, and executives in disputes involving construction defects, delay and impact claims, design and professional liability, code and accessibility issues, payment and cost recovery, noncompetition covenants, insurance coverage, and partnership disputes.

Clients turn to Brad when a dispute requires both boardroom judgment and courtroom readiness. He has tried matters to juries and courts, prosecuted and defended complex arbitrations, handled significant mediations and settlements, and represented clients in commercial appeals. His trial experience gives clients a practical view of leverage, evidentiary risk, witness credibility, damages, and settlement value. Brad's goal is not simply to litigate hard, but to help clients make the right business decision at each stage of a difficult dispute.

  • Recovered a $4 million dollar liquidated damages dispute for a multi-family house project developer against a national construction company.
  • Recovered a $3.2 million jury verdict for a developer on breach of contract and professional malpractice claims against an architect that failed to design a large condominium project in compliance with FHA accessibility requirements and the International Building Code.
  • Successfully prosecuted a multi-million-dollar construction delay claim for a developer against a national contractor that delivered a downtown apartment building eight months beyond the substantial completion deadline and sought to excuse the delay based on adverse weather.
  • Successfully defended a seven figure soil stability and settlement claim for a national home builder.
  • Successfully prosecuted a construction defect jury trial involving water intrusion.

Commercial, Real Estate and Financial Disputes

  • Successfully prosecuted a bench trial obtaining a favorable decision in a complex partnership dissolution dispute.
  • Obtained a favorable decision from the Idaho Supreme Court in a complex commercial dispute involving a dairy and livestock business, Green River Ranches, LLC v. Silva Dairy, LLC, 162 Idaho 385, 397 P.3d 1144 (2017).
  • Successfully prosecuted a security recovery lawsuit involving a multi-million-dollar bond issuance.
  • Represented a national agricultural lender in a multimillion-dollar agricultural foreclosure lawsuit involving property in four Idaho counties.
  • Successfully prosecuted a cost recovery claim for an international mining company in a four-day bankruptcy court trial.

Employment, Restrictive Covenants and Trade Secret Disputes

  • Successfully prosecuted claims for a local hand surgeon involving wrongful expulsion from a limited partnership and enforcement of a noncompetition covenant, resulting in a jury finding the covenant unenforceable and a $1,524,299.10 judgment in favor of the surgeon.
  • Obtained a declaratory judgment invalidating a noncompetition covenant for a highly specialized spinal deformity surgeon on public policy grounds.
  • Successfully defended an AAA arbitration involving trade secret misappropriation, wage claims, breach of fiduciary duty and noncompetition agreement violations.
  • Successfully defended a private arbitration for a national health club corporation involving allegations of sexual orientation discrimination and wrongful termination.

Insurance, Products and Operational Risk

  • Successfully defended jury trials involving insurance coverage, bad faith, products liability and food safety claims.
  • Successfully defended over-limit transport clearances against a challenge by environmental special interest groups.
  • Successfully defended bad faith and class action claims against an international rental car company.
